Terms of Use
1. Acceptance of Terms
By accessing or using the TableTing platform (the "Service"), you agree to be bound by these Terms of Use ("Terms") and our Privacy Policy. If you do not agree to these Terms, you may not access or use the Service. These Terms constitute a legally binding agreement between you and Node 13 ("we," "us," or "our").
If you are using the Service on behalf of a business or other legal entity, you represent that you have the authority to bind that entity to these Terms, in which case "you" refers to that entity.
2. Description of Service
TableTing is a software-as-a-service platform that enables restaurants and food service businesses ("Restaurant Operators") to manage service requests from customers via QR code-based interactions. The Service includes dashboards for restaurant owners, management interfaces for wait staff, and customer-facing request pages accessible by scanning QR codes.
We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice where practicable.
3. Accounts and Registration
To access certain features of the Service, Restaurant Operators must create an account. You agree to:
- Provide accurate, current, and complete information during registration;
- Maintain and promptly update your account information;
- Keep your password confidential and not share access with unauthorized parties;
- Notify us immediately of any unauthorized use of your account;
- Be responsible for all activity that occurs under your account.
We reserve the right to terminate accounts that contain inaccurate information or violate these Terms.
4. Subscriptions and Payment
Access to premium features of the Service is provided on a subscription basis. By selecting a paid subscription plan, you authorize Node 13 to charge the applicable fees to your payment method on a recurring basis.
- Billing: Subscription fees are billed in advance on a monthly or annual basis depending on your selected plan.
- Payment Processing: All payments are processed securely through Stripe. By providing payment information, you also agree to Stripe's Terms of Service.
- Price Changes: We may modify subscription pricing with at least 30 days' prior notice. Continued use after the effective date constitutes acceptance of the new pricing.
- Cancellation: You may cancel your subscription at any time from your account dashboard. Your access will continue until the end of the current billing period. We do not provide prorated refunds for partial periods.
- Refunds: Subscription fees are non-refundable except where required by applicable law or at our sole discretion.
5. Permitted Use
You may use the Service only for lawful purposes and in accordance with these Terms. You agree not to:
- Use the Service in any way that violates applicable local, national, or international law or regulation;
- Attempt to gain unauthorized access to any part of the Service or its related systems;
- Transmit any unsolicited or unauthorized advertising or promotional material;
- Engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Service;
- Reverse engineer, decompile, or disassemble any component of the Service;
- Use automated means (bots, scrapers, crawlers) to access the Service without our prior written consent;
- Introduce viruses, trojans, worms, or other malicious or technologically harmful material.
6. Content and Data
You retain ownership of all content and data you submit to the Service ("Your Content"). By using the Service, you grant Node 13 a limited, non-exclusive, royalty-free licence to host, process, and display Your Content solely to the extent necessary to provide the Service.
You are solely responsible for Your Content and for ensuring it does not violate the rights of any third party or any applicable law. We reserve the right (but not the obligation) to remove any content that we determine, in our sole discretion, violates these Terms or is otherwise objectionable.
We may use aggregated and anonymised data derived from use of the Service for the purposes of improving and developing the platform. Such data will not identify you or your customers individually.
7. Intellectual Property
The Service and its original content, features, and functionality are and will remain the exclusive property of Node 13 and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.
8. Third-Party Services
The Service may contain links to or integrations with third-party websites and services that are not owned or controlled by Node 13. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party services. We strongly advise you to review the terms and privacy policies of any third-party services you access through the Service.
9. Termination
We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease.
If you wish to terminate your account, you may do so by cancelling your subscription and contacting us to request account deletion. We will retain your data for a reasonable period after termination as required by law or legitimate business purposes, after which it will be deleted in accordance with our Privacy Policy.
10. Disclaimer of Warranties
The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.
11. Limitation of Liability
To the fullest extent permitted by applicable law, in no event shall Node 13, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, goodwill, or other intangible losses, resulting from:
- Your access to or use of (or inability to access or use) the Service;
- Any conduct or content of any third party on the Service;
- Any content obtained from the Service;
- Unauthorised access, use, or alteration of your transmissions or content.
Our total liability to you for any claims arising from these Terms or your use of the Service shall not exceed the greater of (a) the total amount paid by you to us in the twelve months preceding the claim, or (b) one hundred dollars (USD $100).
12. Indemnification
You agree to indemnify, defend, and hold harmless Node 13 and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any third-party rights.
13. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with applicable law, without regard to its conflict of law provisions. Any dispute arising from or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If resolution cannot be reached, disputes shall be subject to the exclusive jurisdiction of the courts of competent jurisdiction.
14. Changes to These Terms
We reserve the right to modify these Terms at any time. When we make material changes, we will provide at least 14 days' notice by updating the "Last updated" date at the top of this page and, where practicable, by sending you an email notification. Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of those Terms.
